Sounds like maybe a weak shift return spring.

I think that there is an upgrade spring for the shift-return. It is much beefier than the original. I am just about to start to go through my trans and Larry from GT Motors in Lansing, MI showed me what the original and the new ones looked like so that I would know if the trans had been upgraded. Larry told me that this was one of the weakest parts of the trans.
I am also going to be doing the O-ring upgrade to the clutch rod. I had a problem where trans fluid got onto the friction surfaces. I think most of it had to do with my using the level plug as level indicator and overfilling the trans.

As for the whinging, I think the older 4 speeds, maybe all of them, had straight cut gears which tend to be noisier. I haven't been able to ride my 5 speed for several years, so I don't remember how much noise it made.
